The EPA identified certain past practices by the facility, primarily related to reporting, record-keeping and the timing of certain action, which the EPA contends did not fully meet applicable regulatory or permit standards. The agency did not allege that Hydro had exceeded an applicable emission limitation.
Hydro resolved the case through a “stipulation of settlement” entered in federal court by the federal government and Hydro, which provided for a payment by the company of USD 310,000.
Testing has confirmed that the facility in St. Augustine is in full compliance with applicable emission limits under the regulations and the air permit. Hydro is committed to compliance with its permits, as well as all applicable federal and state statutes and regulations.
